Terms of Use

1. About These Terms

These Terms of Use govern your access to and use of the Adrift website and application. By using Adrift, you agree to these terms. If you do not agree, do not use the service.

2. The Adrift Service

Adrift is a digital ship log for leisure sailors and motor boat owners. The service allows users to create accounts, maintain boat profiles, record voyages, add waypoints and maintenance entries, upload photos, and share voyage content privately or publicly.

3. Accounts and Access

You are responsible for keeping your login methods secure and for activity that happens through your account. You must provide accurate account information and use Adrift only for lawful purposes. We may suspend or restrict access if we reasonably believe an account is being misused or puts the service or other users at risk.

4. Your Content

You retain ownership of the content you submit to Adrift, including voyage logs, notes, boat details, maintenance records, photos, comments, and profile information. You grant Adrift a non-exclusive licence to host, process, store, copy, and display that content as needed to operate and improve the service.

You are responsible for the content you upload or publish. You must have the rights and permissions needed to share it, including permission from other people who appear in photos or whose personal information you include.

5. Public Sharing and Social Features

Voyages are private by default unless you choose to share them. If you publish a voyage, share a link, post comments, follow a skipper, or use likes or similar social features, you understand that related content and activity may be visible to other users or anyone with the relevant public page or share link.

You should not share content that is confidential, commercially sensitive, abusive, defamatory, misleading, or unlawful. We may remove shared content or social activity that breaches these terms or creates legal, privacy, or safety concerns.

6. Acceptable Use

You must not:

  • use Adrift to break the law or infringe another person's rights;
  • upload malicious code, attempt unauthorised access, or interfere with the service;
  • scrape, reverse engineer, or misuse the platform except where the law does not allow that restriction;
  • post content that is fraudulent, abusive, threatening, obscene, or invasive of privacy;
  • impersonate another person or misrepresent a voyage, vessel, or account.

7. Navigation and Safety

Adrift is a record-keeping and sharing tool. It is not a substitute for proper seamanship, navigation charts, safety equipment, weather information, emergency communications, or professional advice. You are solely responsible for vessel operation, route planning, safety decisions, and compliance with maritime laws and local regulations.

8. Availability and Changes

We may update, modify, suspend, or discontinue parts of Adrift from time to time. We do not guarantee uninterrupted or error-free availability. We may also remove content or limit functionality where reasonably necessary for maintenance, security, legal compliance, or product changes.

9. Intellectual Property

Adrift and its branding, software, and design are owned by or licensed to us and are protected by intellectual property laws. These terms do not transfer any ownership rights to you other than the limited right to use the service in accordance with these terms.

10. Liability

Nothing in these terms excludes or limits liability that cannot legally be excluded under applicable UK law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

Subject to that, Adrift is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, loss of data, or losses arising from your reliance on user-generated voyage content, route information, comments, or shared pages.

11. Ending Use of the Service

You may stop using Adrift at any time. We may suspend or terminate your access if you materially breach these terms, create risk for other users, or where we are required to do so by law. Clauses that are intended to continue after termination, including ownership, liability, and governing law terms, will continue to apply.

12. Governing Law

These terms and any non-contractual disputes arising from them are governed by the laws of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from any mandatory protections available under the laws of your part of the UK.

The courts of England and Wales will have jurisdiction over disputes relating to these terms, except where applicable consumer law allows you to bring a claim in another part of the United Kingdom.
